Hello, Rodaregal, and welcome to Wikipedia! I have noticed that you are fairly new! I hope you like the place and decide to stay. I also see that some of your recent edits show an interest in the use of images and/or photos on Wikipedia.

Hi Rodaregal. I've removed File:Cameron, Barbara (1996) - by Robert Giard - Copyright Estate of Robert Giard.jpg that you uploaded to Commons from Barbara May Cameron because (1) it doesn't have a copyright license and (2) there's no license accepted by Commons that can be applied under the conditions imposed by the photo's copyright holder added to the file's description. There are more details about this at c:User talk:Rodaregal and you're welcome to ask any questions about this thing there. For reference, Commons will only host content that satisfies c:Commons:Licensing. This basically means that content has to be either within the public domain (either never eligible or no longer eligible for copyright protection) or released under a free license accepted by Commons. -- Marchjuly (talk) 10:26, 27 May 2023 (UTC)

Understandable for the commons however I was given permission by the copyright holder of the famous photographer Robert Giard's estate, his widower John Silin, to use the image for Barbara May Cameron's Wikipedia article. That said, the cropped version added by a previous editor of the article is strictly against the instructions given by John Silin.

He left clear instructions so we can use the photograph:

1) The image may not be cropped or altered without my express permission.

2) Next to the image it must say, “Photo by Robert Giard; Copyright Estate of Robert Giard.”

3) You may not use the photo for any other purposes without my express permission.

I have reverted your edit. Either you use the edit I specifically made for the photograph or you delete the image and any other cropped images of Robert Giard's photograph. Wikipedia cannot use this photograph cropped without permission. Rodaregal (talk) 12:15, 27 May 2023 (UTC)

As I explained above, the permission you received for the file you uploaded to Commons is not sufficient since it places too many restrictions on reuse. Please don't re-add that file to the article until you're able to sort out its copyright license or gain the consent of the copyright holder. As for the file uploaded locally to English Wikipedia, that file was uploaded as non-free content under a non-free copyright license in accordance with Wikipedia's non-free content use policy. Non-free content doesn't require copyright holder's consent to be uploaded and used on Wikipedia; it only requires that the content's non-free use be in accordance with relevant Wikipedia policies and guidelines. If you feel this particular file doesn't comply with those policies and guidelines, you can start a discussion about it at WP:FFD explaining why. If others agree with your assessment and a consensus is established that the file doesn't comply, it will be removed from the article. Under US copyright law, the concept of fair use allows copyrighted content to be used without copyright holder consent as long as certain conditions are met, and Wikipedia's non-free content use policy is just a stricter application of fair use for Wikipedia's purposes. If you disagree with what I posted above and want to seek feedback from others, you can either start a discussion at FFD as I mentioned above, or you can ask about the file at WP:MCQ or WT:NFCC. -- Marchjuly (talk) 12:57, 27 May 2023 (UTC)

You're coming close to edit warring now and running the risk of your account being blocked by a Wikipedia administrator. As I explained above, copyright holder permission isn't needed for non-free use. I've update decription of File:Barbara May Cameron.png to properly attribute the file Robert Giard and his estate and to clarify the the author of the file isn't Ms. (magazine) but is Giard. This is all that is required for non-free use. If you don't like the cropped version, you can go to the file's page, click on "Upload a new version of this file" and then upload the version with the white border. -- Marchjuly (talk) 13:38, 27 May 2023 (UTC)

I don't know if you have a reading comprehension issue but I got into contact with John Silin and he does not approve of the cropped image added - A CROPPED VERSION OF THE ONE I ADDED. Look at the image that you are allowing - IT IS THE EXACT SAME PHOTOGRAPH BUT CROPPED!!!!!!!!!

In this email he specifically stated:

Rodrigo,

I did not upload the Giard image to the Wikipedia site nor did I give anyone else but you permission to do so. The image up now is cropped and without immediate reference to Robert Giard or copyright which it must have or it will need to be taken down.

THIS IS NOT ALLOWED BY THE OWNER OF THIS IMAGE!!!! Get that through your skull. That is why I edited the page in the first place so you either keep my edit (that follows his instruction) or you remove both images that is what I said but you clearly did not read what I wrote! Please don't post in all caps. It's shouting and unnecessary. I understand much more than you do about Wikipedia and Common's image use policy, and I've been trying to explain to you what needs to be done here. I've updated the png file's page to reflect to the proper author and copyright holder of the file. An uncropped version of the photo can be uploaded as non-free content as I explained above simply by going to the file's page, clicking on "Update a new version of this file". Doing so will replace the older version with the newer one. If you don't want to upload the file in png format, you can simply upload a jpg version of the file as non-free content as explained in WP:UPLOAD. Proper attribution to Giard and his estate can be given in the file's description, which is what I did for the png file. It can also be given in some form in the file's caption, which is what I also did. Finally, since you've been in contact with Giard's estate, you should let them know that the same photo or crops of it are being used online by quite a number of websites as shown here, here, here, here, here, here, etc. which means there are other people who've done what the uploader of the file to Wikipedia did: cropped out the white border as extraneous. That doesn't mean they were right in doing so, just that it's also been done elsewhere most likely under the concept of fair use. -- Marchjuly (talk) 14:08, 27 May 2023 (UTC)

I do not question your knowledge on Wikipedia and their rules. I was questioning what seemed like an arbitrary edit where you were allowing the exact same photograph cropped by a previous editor but deleting one that follows the copyright holder's instruction. I apologize for the caps but I felt like you weren't reading what I stated, since you continued repeatedly to put up the exact same cropped photograph, and so I felt I needed to emphasize the fact that the copyright holder, Johnathon Silin, does not accept the use of that cropped image.
