You must not have fully read the license tag applied to File:GracieAllen.jpg. The photo was in copyright at one time, but has fallen out of copyright due to the age of the photo. Copyrights on a particular item do not exist forever. The photo in question was made in 1926. It falls into the 1923-1969 public domain category as stated on the license tag.
