Most images are greater than 70 years old and are from the company archives that I have. I don't think I am including the copy right correctly. Can you help me?

I notice the file page specifies that the file is being used under fair use but there is not a suitable explanation or rationale as to why each specific use in Wikipedia constitutes fair use. Dear Delta, Sexton Foods is defunct (no longer operates) all assets were absorded into US Foodservice. US Foodservice does not use the brand. However, I feel that the histories of sexton foods and other wiki pages I have authored: CFS Continental, S.E. Rykoff are important to understanding how modern foodservice evolved. Author (Thomas Mackin) has never been employed by any of the companies. However, through personal interest, I have been able to gather material on John Sexton & Co, CFS Continental and S.E. Rykoff. Can you suggest a way the images can be labeled (copyright information) so that they can appear on the Wiki. I believe it is impossible to find out who took the pictures tl|PD-EU-no author disclosure I believe the images offer a variety of wiki users valuable information: Chicago achitectural history, Diamond T Trucks, electric trucks in Chicago, pre interstate highway, railroad shipping, foodservice development, changing corporate financial structure from family owned to public company in the 1960s, Mergers & Acquisitions, development of frozen foods, etc. Please let me know your thoughts. Dear ΔT, I believe I addressed the majority of the copy right issues that you brought up. Most images posted on Sexton Foods were re-classified as public domain "PD-1923" since the majority of the images were taken/published prior to 1923. The other images published/created after 1923 are classified as fair use.... Permission...Used under fair use rationale to depict John Sexton, etc. in the Wikipedia article Sexton Foods. No known free use images are known to exist. Photograph is not replaceable since John Sexton, etc. died in 1930. Response to copyright query[edit]

Hello,

Wikipedia's servers are located in the US and therefore must abide by US copyright law. Since the United States does not apply the rule of the shorter term, it is possible for some images to be in the public domain in their country of first publication but not in the US. Such images are not eligible to be classified as free for Wikipedia use (unless they are freely licensed as well), and non-free images can only be used under WP:NFCC. Let me know if this helps. Thanks for your response. The copy right issue for Sexton Foods is difficult since the majority of the images are over 80 years old. I believe they are in the public domain given the age. There is no way of finding out who took the picture (the author). Can you suggest what I should do? I attempted to make the copy right changes so that I follow the Wiki Guidelines. Except for lack of compliance with US formalities in a publication in the United States, works published since 1923 are not in the public domain. It will remain this way until 2019 (unless Congress again retroactively extends the term of copyright). RJaguar3 | u | t 01:30, 13 April 2011 (UTC)[reply]
